Terms of Service

1. Acceptance of Terms

By accessing or using Trice ("Service"), including the website (trice3d.com), web application (app.trice3d.com), and desktop application, you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Trice is a 3D studio and model viewer that allows you to import, edit, optimize, and share 3D models. It also offers AI generation, which turns an image you provide into a 3D model.

The desktop application works entirely offline and does not require an account. AI generation is available only in the web application and requires a registered account.

3. Accounts

You must be at least 13 years old to create an account. If you are under 18, you may use Trice only with the permission of a parent or legal guardian, who accepts these Terms on your behalf. Where local law sets a higher minimum age for online services or for consent to data processing, that higher age applies.

AI generation carries a higher age requirement of its own — see Section 7.

To use certain features of the web application, you must sign in using a third-party authentication provider (GitHub or Google) or an email sign-in link. You are responsible for maintaining the security of your account and for all activity that occurs under it.

You can also use the Studio as a guest without signing in. Guest sessions are temporary: they are removed automatically after a few days, together with anything stored in them. Sign in to keep your work.

You must not create accounts through automated means or use another person's account without permission.

4. Subscriptions and Payments

Trice offers Free and Pro subscription plans. The Free plan includes limited features and a Trice watermark on shared scenes.

Pro subscriptions are billed monthly or annually through Lemon Squeezy, which acts as the Merchant of Record for all transactions. Lemon Squeezy handles payment processing, invoicing, tax collection, and refunds.

Pro subscriptions renew automatically. You may cancel at any time from your dashboard. Cancellation takes effect at the end of the current billing period.

Refund requests are handled in accordance with Lemon Squeezy's refund policy. For EU and UK customers, a 14-day cooling-off period applies to subscription purchases as required by law. Generations are purchased separately and are covered by Section 5.

5. Generations

AI generation is paid for with prepaid units called "generations" (also referred to as credits). They are sold in packs as one-time purchases through Lemon Squeezy and can be bought on any plan, including Free.

A generation is a prepaid licence to use the generation feature. It is not money and not a stored-value instrument. Generations have no cash value, and cannot be transferred between accounts, exchanged, or redeemed for cash.

Generations do not expire. Unused generations stay on your account for as long as the account exists.

One generation is consumed per request, whatever settings you choose. If a generation fails or does not complete, it is returned to your balance automatically. A delivered result counts as used, including when you are not satisfied with it.

Generations are non-refundable once used, because the service is performed immediately at your request. By buying generations and using them, you ask for immediate performance and accept that you lose your statutory right of withdrawal for the generations you have used. Unused generations remain refundable for 14 days after purchase for EU and UK customers.

If a purchase is later refunded or charged back after some of its generations were used, your balance may become negative. A negative balance must be cleared before you can generate again.

If you delete your account, any unused generations are lost and are not refunded.

6. Your Content

You retain all ownership rights to the 3D models, textures, images, and other files you upload to Trice ("Your Content"). By uploading content, you grant Trice a limited licence to store, process, and display Your Content solely for the purpose of providing the Service to you.

Some features depend on external processing. When you use such a feature — most notably AI generation — you authorise us to transmit the content that feature needs to the relevant provider, solely in order to deliver it to you. Our Privacy Policy describes this in detail.

When you share a scene via a Share URL or embed it on a third-party website, Your Content becomes publicly accessible. You are solely responsible for ensuring you have the rights to share such content.

You must not upload content that infringes on the intellectual property rights of others, contains malware, or is otherwise illegal.

7. AI Generation

Age requirement. You must be at least 18 years old, or the age of legal majority where you live, to use AI generation. The third-party AI providers we rely on to operate this feature require it, and we are obliged to pass that requirement on to you.

Your input image. You are responsible for the image you upload. You must own it or otherwise hold the rights to use it for this purpose. Do not upload images that infringe someone else's rights, and do not upload images of identifiable people without their consent.

How it is processed. To build a model, your image is transmitted to third-party AI providers that we use to operate the feature. We do not keep the image itself after the request is made.

The result is yours. As between you and Trice, you own the 3D model generated from your image, and you may use it commercially. Trice claims no ownership of generated models. We do not use Your Content to train AI models; third-party providers apply their own terms to the requests they receive.

No guarantee of uniqueness. AI generation is probabilistic. Other users supplying similar images may receive similar results, and we cannot guarantee that any result is unique. The legal status of AI-generated material differs between countries, and we make no representation that a generated model qualifies for copyright protection where you live.

No guarantee of quality. Results depend heavily on the input image. We do not warrant that a generated model will accurately reproduce its subject or be fit for any particular purpose.

8. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose
• Upload or share content that is harmful, infringing, or violates the rights of others
• Upload images of identifiable people without their consent
• Use AI generation to create sexually explicit material, content depicting minors, or content intended to deceive, harass, or impersonate
• Present a generated model as a scan, measurement, or technically validated representation of a real object
• Fail to disclose that a model was AI-generated where it could reasonably be mistaken for a scanned or measured one
• Attempt to circumvent plan restrictions, generation limits, or the generation balance system
• Attempt to gain unauthorized access to the Service or its systems
• Interfere with or disrupt the Service or its infrastructure
• Reverse-engineer the Service, except where permitted by law
• Use the Service to distribute spam or unsolicited content
• Resell or redistribute the Service without permission

We may suspend access to AI generation, or to the Service as a whole, if we believe these rules are being broken.

9. Intellectual Property

The Trice name, logo, website, application code, and all related materials are the property of Trice. Nothing in these Terms grants you any right to use the Trice brand or trademarks.

10. Copyright Infringement

If you believe that content hosted on Trice infringes your copyright, please contact us at hello@trice3d.com with the following information:

• A description of the copyrighted work
• The URL of the infringing content on Trice
• Your contact information
• A statement that you have a good-faith belief the use is unauthorized

We will review all valid reports and take appropriate action, including removing infringing content.

11. Data, Backups and Content Removal

While we take reasonable measures to protect your data, you are responsible for maintaining your own backups. Trice is not liable for any loss of data.

Generated models are held in temporary storage for 30 days. Save a generated model into a project to keep it beyond that.

When you delete a project, the associated files are permanently removed from our servers. You can delete your account at any time from the account menu in the dashboard. When you delete your account, all your data is permanently deleted.

Content that breaks the rules. We may remove content that violates these Terms or the law, or where we are required to do so by law. Where it is practical and lawful to tell you, we will.

Inactive free accounts. Storing 3D models costs us money, so we reserve the right to delete the content of free accounts that have been inactive for 12 months or longer. We will email you before anything is removed and give you time to respond. Signing in is all it takes to keep everything, and it starts the clock again. This does not apply to accounts with an active paid subscription.

If your subscription ends. Your projects are not deleted when a Pro subscription lapses. The most recently updated ones stay editable within the Free plan limits and the rest become read-only, so nothing is lost while you decide what to do.

12. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or free from harmful components.

13. Limitation of Liability

To the maximum extent permitted by law, Trice shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill arising from your use of the Service.

14. Termination

We may suspend or terminate your access to the Service if you breach these Terms, if we are required to by law, or if your use puts the Service or other users at risk. You may stop using the Service at any time.

Upon termination, your right to use the Service ceases immediately.

What happens to your content. If we terminate your account, we keep your content for 30 days so that you can ask us for a copy, and delete it after that. Content that is illegal, or that we are required to remove, may be deleted straight away.

Sections 5, 6, 9, 12, 13, and 15 survive termination.

15. Changes to Terms

We may update these Terms from time to time. If we make significant changes, we will notify you by updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the updated Terms.
